1. Accounts
When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account. You are responsible for safeguarding your password and for all activities that occur under your account.
2. Use License
Subject to your compliance with these Terms, Swiqe grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application for your personal, non-commercial use on a mobile device owned or controlled by you.
3. Acceptable Use
You agree not to use the Service to: - Violate any laws or regulations. - Infringe the rights of others (including intellectual property rights). - Transmit any harmful or malicious code. - Engage in academic dishonesty or fraudulent misrepresentation (e.g., using Copilot to cheat in exams or interviews where use of AI is prohibited).
4. Subscriptions
Some parts of the Service are billed on a subscription basis ('Subscription(s)'). You will be billed in advance on a recurring and periodic basis ('Billing Cycle'). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription. You may cancel your Subscription renewal either through your online account management page or by contacting our customer support team.
5. Intellectual Property
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Swiqe Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
6. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
7. Limitation of Liability
In no event shall Swiqe Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.
8. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an 'AS IS' and 'AS AVAILABLE' basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. Swiqe Inc. does not guarantee that the Service will function uninterrupted, secure or available at any particular time or location.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.
10. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
